Boundaries to be Confirmed for Water District Study Resolves Uncertainties, Uncovers 13-Year Lapse in Tax Payments
COMMERCE CITY, Colo. (Feb. 5, 2008) – The South Adams County Water & Sanitation District, in conjunction with the County Assessor’s Office, is in the process of officially confirming its boundaries, a project that will allow recall election petitions to be evaluated and the District to begin collecting taxes in a subdivision known as Eagle Creek. The study of the boundaries was prompted by a petition for an election seeking the recall of three District board members. Now that the information about the boundaries has been provided, a judge will determine whether the recall election will go forward. While the District satisfactorily addressed the assessor’s concerns regarding the inclusion of more than 300 properties within the District, an issue regarding Eagle Creek also became apparent during the course of the study. About 400 households within Eagle Creek had been receiving services but not paying taxes that would have gone toward the District’s general funds. “Eagle Creek was one of the first developments in the northern area of Commerce City, established in 1995,” said Greg Fabisiak, general manager of the District since 2004. “It appears that some paperwork should have been filed to establish Eagle Creek residents on the tax-paying rolls, but somehow it was omitted. We are looking into the cause.” At an average of $50-$60 of taxes per household per year, the shortfall over that period could be up to $100,000. There is no legal basis to collect those back-taxes, due to the complexity of the issue and the transience of some residents. The District will begin contacting the individual property owners to advise them of the need to file inclusion papers. Residents will need to get their properties included in order to be eligible to vote in elections affecting the District. |
